Terms of Service

1. Acceptance of Terms

By accessing or using the CarHaki platform at carhaki.ug (the "Platform"), including all associated services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Platform.

CarHaki is operated by CarHaki Limited, a company incorporated in Uganda ("CarHaki", "we", "us", or "our"). These Terms govern your access to and use of the Platform, including vehicle history report services, payment processing, and all related features.

2. Description of Services

CarHaki provides vehicle history verification reports for used vehicles imported into Uganda from the United States of America and Japan. Our services include:

• Free basic vehicle identification using publicly available government data
• Basic Reports containing vehicle specifications, title summary, and recall status
• Full Reports containing complete accident history, odometer records, title brands, theft records, auction history (Japan), and AI-generated plain-English analysis
• PDF export of generated reports
• Shareable report links for buyers wishing to share verified history with third parties
• Dealer account services including bulk report credit packages

3. Eligibility and Account Registration

You must be at least 18 years of age to register an account or purchase a report. By creating an account, you confirm that all information you provide is accurate, current, and complete.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at support@carhaki.ug if you suspect any unauthorised access to your account.

CarHaki reserves the right to suspend or terminate any account that violates these Terms, provides false information, or engages in fraudulent activity.

4. Report Accuracy and Limitations

CarHaki reports are compiled from data held in official government databases in the United States (NMVTIS, NHTSA) and Japan (MLIT and auction records). The accuracy and completeness of a report depends entirely on what information has been reported to and recorded in those databases.

NMVTIS Consumer Notice (USA Vehicles): Not all states, insurance companies, and salvage yards are required to report to NMVTIS. A vehicle that has been declared a total loss or salvage may not appear in NMVTIS data if it was not reported. CarHaki reports may not reflect every event in a vehicle history. We strongly recommend a physical inspection in addition to any CarHaki report.

CarHaki does not guarantee the accuracy, completeness, or timeliness of any report. We are not responsible for any purchase decision made based on information contained in a CarHaki report.

5. Payment Terms and Refund Policy

All payments are processed in Uganda Shillings (UGX) through Flutterwave, which supports MTN Mobile Money, Airtel Money, and Visa/Mastercard. Prices are as displayed at the time of purchase. VAT or other applicable taxes may apply.

Refund Policy: Once a report has been successfully generated, the payment is non-refundable. This is because the data retrieval cost from third-party providers is incurred at the moment of generation and cannot be recovered.

Refunds are considered only in the following circumstances:

• The system completely failed to generate a report after payment was confirmed
• A duplicate payment was made for the same vehicle within 30 minutes
• A technical error on our side resulted in an incorrect charge

To request a refund, contact us at support@carhaki.ug within 7 days of the transaction with your transaction reference number.

6. Prohibited Uses

You must not use the Platform to:

• Conduct bulk or automated searches without prior written agreement with CarHaki
• Resell or redistribute report data to third parties without authorisation
• Access, tamper with, or attempt to reverse-engineer any part of the Platform
• Submit false or misleading information during registration or payment
• Use the Platform in a manner that violates any applicable Ugandan or international law
• Attempt to circumvent any rate limiting, access controls, or security measures

7. Intellectual Property

The CarHaki Platform, including its design, code, branding, AI analysis methodology, and grading system, is the intellectual property of CarHaki Limited. You may not copy, reproduce, distribute, or create derivative works based on the Platform without our express written permission.

Report data sourced from government databases is subject to the licensing terms of those respective authorities. NMVTIS data is licensed for personal, non-commercial use by the consumer for whom the report was generated.

8. Data Privacy

CarHaki collects and processes personal data in accordance with the Uganda Data Protection and Privacy Act 2019. Please read our Privacy Policy for full details of what we collect, how we use it, and your rights.

9. Disclaimer of Warranties

The Platform and all reports are provided on an "as is" and "as available" basis. CarHaki makes no warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Platform will be uninterrupted, error-free, or free from viruses or other harmful components. We do not warrant that any report will be complete, accurate, or up to date.

10. Limitation of Liability

To the maximum extent permitted by Ugandan law, CarHaki Limited, its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform or any report, including but not limited to:

• Any financial loss arising from a vehicle purchase decision informed by a CarHaki report
• Any mechanical failure of a vehicle that was not disclosed in available data
• Loss of business, profits, or anticipated savings

In all cases, the total aggregate liability of CarHaki to you shall not exceed the amount you paid for the specific report giving rise to the claim.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Uganda. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Uganda.

12. Changes to These Terms

CarHaki reserves the right to update these Terms at any time. We will notify registered users by email when material changes are made. Continued use of the Platform after any such changes constitutes your acceptance of the new Terms.
